Frankly speaking, Indonsian law enforcement have not reached a level where consistency is upheld. The court or other law officer may give vary decisions to the same cases. This is because Indonesian judges and law officers are not bound by previous court decisions and each judge and law officer act independently, but it doesn’t mean that there is no legal certainty. The court decisions must be based on law (regulations or unwritten law that existed in a society), but the interpretation of the law may vary depends on the judges’ or law officer’s understanding to the related laws and facts.
So that in the settlement of litigation cases it is very important to conduct efforts to provide understanding of the law and facts to judges and other law enforcers so that their understanding is in accordance with the law.
