Patent Right

A patent is an exclusive right granted by the State to an Inventor for the results of his invention in the field of technology, which for a certain period of time utilizes its own invention or gives its approval to another party to utilize it.

Invention means an inventor’s idea that is poured into a specific problem-solving activity in the field of technology which can be in the form of a product or process, or improvement and development of a product or process.

Invention is considered as new if on the Filing Date, the Invention is not the same as the technology disclosed previously, so that the legal protection of a new invention commences from the date of patent filing to the government i.e. directorate general of intellectual property rights of Ministry of Law and Human Rights.

The law also protects invention which has been published with written, oral description or through demonstration, utilization, or other method in Indonesia or abroad.
